Can my lawyer be present when I testify in a grand jury?
Under Rule 6(d) of the Federal Rules of Criminal Procedure, only certain individuals are permitted to be in the grand jury room – like the prosecutor, witnesses (when testifying), court personnel, and an interpreter if needed. Your personal attorney is not typically allowed to join you inside while you testify. If you are called to appear, your lawyer must usually wait outside the grand jury room. You can, however, step out and consult with your attorney during breaks.
